Quotes and Bookings
MiCon issues quotes only after confirming the event details and the artist’s availability. The quoted price is firm for the described services and remains valid until the due date stated in the quote or invoice. A booking becomes confirmed when the client pays the fifty percent (50%) reservation fee and MiCon sends written confirmation. If the client later changes the date, times, location, duration, lineup, technical requirements, or overall scope (e.g., significant changes to guest count or event type), MiCon will update the price as needed and request the client’s explicit approval before proceeding. Before accepting a booking, MiCon may request practical information such as access, power supply, schedules, or permits to ensure safe and lawful delivery of the event.
Payments, Cancellations, and Refunds
Payments
To confirm a booking and lock the date, the Client must pay a non‑refundable reservation fee equal to fifty percent (50%) of the total fee. The reservation fee guarantees the artist’s availability and covers administrative preparation for the event. Unless otherwise stated, the remaining balance must be paid within twenty‑four (24) hours following the event, or on‑site in cash as previously agreed in writing. Payments are accepted by bank transfer or cash only, unless otherwise agreed in writing by MiCon.
All payments must be made directly to MiCon to ensure proper processing and confirmation. MiCon will issue an invoice or payment request containing the relevant payment details, and the booking will only be secured once payment is received and written confirmation is sent. Invoices are delivered by email, and it is the Client’s responsibility to ensure they are received and reviewed in a timely manner. Quoted availability and pricing are not guaranteed until MiCon confirms the booking in writing.
Cancellations by the Client
If the Client cancels more than thirty (30) days before the event, the reservation fee is non‑refundable, but no further payment is required.
If the Client cancels between seven (7) and thirty (30) days before the event, seventy‑five percent (75%) of the total fee is due.
If the Client cancels between forty‑eight (48) hours and seven (7) days before the event, eighty‑five percent (85%) of the total fee is due.
If the Client cancels less than forty‑eight (48) hours before the event, one hundred percent (100%) of the total fee is due.
All cancellation charges are due within seven (7) days from the cancellation notice. MiCon reserves the right to charge interest at a rate of one‑point‑five percent (1.5%) per month, or the maximum rate permitted by law, on any overdue cancellation fees or outstanding balances. If the Client cancels a confirmed booking and a cancellation fee becomes payable under MiCon’s Payment, Cancellations & Refunds Policy, MiCon will retain its 15 % commission and remit the remaining 85 % of any amount actually recovered from the Client to the Artist within 7 days of receipt
Cancellations by the Artist
• More than 30 days before the gig: no financial penalty (may result in delisting for repeat cancellations).
• 30–8 days before the gig: no financial penalty (may result in delisting for repeat cancellations).
• 7–4 days before the gig: 10% of the agreed fee (minimum €50) payable to MiCon.
• 72–24 hours before the gig: 25% of the agreed fee payable to MiCon.
• Less than 24 hours or no‑show: 50% of the agreed fee payable to MiCon and likely removal from the roster.
Documented medical emergency or force majeure (with proof) may waive penalties. Penalties are payable within 7 days of invoice and may be deducted from any amounts otherwise due to the Artist.
Cancellations or changes by MiCon
If a named artist becomes unavailable, MiCon will offer a comparable or better substitute at the same price and will provide the substitute’s profile for the Client’s approval.
If the Client does not accept the substitute, or if MiCon cannot provide a suitable replacement, the Client may cancel and MiCon will refund the reservation fee in full. MiCon will always make reasonable efforts to ensure client satisfaction and to provide an equal or improved alternative whenever possible.
Force Majeure
If an event cannot take place due to circumstances beyond the control of either party (such as extreme weather, illness, accidents, strikes, natural disasters, or government restrictions), both parties will make reasonable efforts to reschedule the event.
If rescheduling is not possible, MiCon will refund all payments received, less any specific third‑party expenses previously approved in writing by the Client and any bank or processing fees that cannot be recovered.
Late Payments
Any payment not received within the specified period may result in additional charges or the suspension of services until payment is made. MiCon reserves the right to charge interest at the rate noted above and to withhold deposits or future services until full settlement of any outstanding amount.
Refunds
Refunds, when applicable, will be processed to the same payment method used by the Client and exclude any bank transaction fees or third‑party processing charges. Please allow up to fourteen (14) business days for processing. In the event of an unjustified payment reversal or chargeback initiated by the Client, MiCon reserves the right to recover the full amount due plus any associated bank, legal, or collection costs.
Talent Substitution and Artist Conduct
If a named artist becomes unavailable, MiCon will offer a comparable or better substitute at the same price and will provide the substitute’s profile for the client’s approval. If the client does not accept the substitute, or if MiCon cannot provide a suitable substitute, the client may cancel and MiCon will refund the reservation fee in full; this does not apply if the client is in breach of the Agreement. Artists engaged by MiCon are expected to maintain professional conduct and adhere to all agreed-upon performance standards and venue rules.
Client Responsibilities and Venue Requirements
The client must provide a safe performance area, adequate power supply, weather protection for outdoor events, timely access for setup and teardown, and an on‑site contact person. The client must ensure that all necessary venue permissions, licenses, and local regulations are met, including noise, safety, and capacity rules. The client is responsible for any venue or third‑party fees, such as sound system rental or permits, unless expressly included in the quote. Overtime, additional sets, extra talent, or technical add‑ons requested on the day may incur additional charges at agreed rates. he client is responsible for any damages caused to the venue or equipment by their guests or themselves during the event.
Fees, Expenses, and Overtime
Quotes include MiCon’s standard agency commission of fifteen percent (15%) on the total artist fee. Travel, accommodation, or special technical requirements may be charged additionally if applicable and pre‑agreed. Overtime is any on-site time beyond the contracted end time, including performance or standby. Overtime is billed in 30‑minute increments at one hundred fifty percent (150%) of the standard hourly rate per talent, with a minimum charge of thirty (30) minutes. Overtime must be approved on‑site by the client or the client’s designated representative, including via WhatsApp or written acknowledgment. Any additional technical, venue, or third‑party costs required to accommodate overtime will be billed separately if applicable.
Liability and Indemnity
To the maximum extent permitted by law, MiCon’s total liability for any claim arising out of or related to a booking is limited to the total fees paid by the client for that specific event. MiCon is not liable for indirect, incidental, special, punitive, or consequential losses, including loss of profits, loss of business, or reputational harm. The client is responsible for ensuring safe conditions at the venue and shall indemnify MiCon and the artist against claims arising from unsafe or non‑compliant venue conditions, except where caused by MiCon’s willful misconduct. MiCon shall be responsible for losses directly and demonstrably caused by MiCon’s willful misconduct. Artists are independent contractors and remain personally responsible for their own acts and omissions. Nothing in this Agreement shall make MiCon liable for an artist’s individual negligence or for incidents outside MiCon’s reasonable control. The Client is responsible for maintaining appropriate event and venue insurance (including property and liability coverage). MiCon strongly recommends that all participating artists carry personal liability insurance.
Intellectual Property and Media
Logos, text, and media on this site are owned by MiCon or used with permission. Do not reproduce them without consent. Unless the client objects in writing, MiCon and the artist may capture and use brief clips or photos from the event for portfolio and social media, respecting privacy and venue rules.
Privacy
Personal data is handled as described in our Privacy Policy and in accordance with applicable data protection laws.
Non‑Circumvention
The Client and the Artist acknowledge that MiCon is the introducing and coordinating party for the booking. For any Client, venue, or event introduced by MiCon to the Artist, and for any Artist introduced by MiCon to the Client, if the Client and the Artist engage again for services within twenty‑four (24) months from the event date, whether for repeat or new events, MiCon shall be entitled to its standard commission of fifteen percent (15%) on the fees payable for such services. This obligation applies regardless of who initiates contact and whether the services are booked directly or through third parties. The Client and the Artist agree not to circumvent MiCon for the confirmed booking and for any immediate extensions, add‑ons, or repeat services related to the same event or date for sixty (60) days from the event date. During this period, any such services must be arranged through MiCon. The Client and the Artist shall promptly disclose to MiCon, upon request, any bookings between them during the 24‑month period, and shall provide reasonable information (such as date, venue, service, and fee) to verify compliance. MiCon’s commission for such bookings shall be payable within seven (7) days of MiCon’s invoice. If the Client or the Artist engages directly in violation of this clause, MiCon is entitled to recover its 15% commission on the fees for such services, plus reasonable collection costs. This clause does not restrict the Client or the Artist from working together after twenty‑four (24) months or on unrelated engagements not originating from MiCon.
Compliance and Conduct
MiCon and the artists will perform services with professional care and in compliance with applicable laws and reasonable venue rules. MiCon may refuse or stop a performance if conditions are unsafe or unlawful. In such cases, fees already due remain payable.
Changes to These Terms
We may update these Terms & Conditions from time to time. Changes apply to new bookings from the date of publication. For significant changes, we will notify users directly via email or a notice on our website.
Severability
If any provision of this Agreement is held invalid, the remaining provisions remain in full force and effect.
Governing Law and Jurisdiction
This Agreement is governed by Spanish law. The courts of Barcelona shall have exclusive jurisdiction.
